FOR SA raises concern about new “hate speech” legislation

In a submission to the Parliamentary Portfolio Committee on Communications this week, FOR SA raised its concern regarding the proposed definition of “hate speech” in the draft Films and Publications Amendment Bill. Our concern is that the definition of “hate speech” in the Bill is broader than the definition of “hate speech” in the Constitution, and as such an impermissible limitation on free speech and unconstitutional. The broad definition will also have a chilling effect on religious freedom and free speech in SA, and should for this reason be amended to reflect the definition of “hate speech” in the Constitution.
